Recoverable Damages in a Car Accident Case
While the actual amount of compensation you can recover in your car accident case depends on many factors, the types of compensation you can pursue remain consistent in all personal injury cases. These types of compensation are called damages.
Generally speaking, there are three main categories of damages, economic, non-economic, and punitive damages. The specifics of your case dictate not only how much compensation you will recover but how many damages you can file a claim for.
Economic and non-economic damages are similar in that their main purpose is to compensate the injury victim for a loss they suffer. Economic damages, also called special damages, compensate for financial losses such as loss of income due to the inability to work and medical expenses.
Non-economic damages, also called general damages, compensates for more intangible losses such as pain and suffering. Texas does place a cap or limit on how much in non-economic damages an individual can be awarded. Not all states have this regulation, however, Texas sets the cap on general damages at $250,000.
